The minimum notice period when resigning in Germany depends on how long the employee has been employed. Typically, an employee should give 4 weeks notice when resigning.
If an employee gives insufficient notice in Germany, employers can claim compensation for loss or harm. It is possible to deduct payment of the employee’s final pay period equal to the prorated salary amount for the time not declared in the notice period.
It is possible to reduce the notice period in Germany under exceptional circumstances, like an untrustworthy or illegal action taken by the employee. Also, if it is agreed upon, both employee and employer, in written terms, then a notice period can be reduced as well.
