Annual leave in Hong Kong (holiday / vacation)

Employees are entitled to paid annual leave in Hong Kong. The amount of annual leave an employee is entitled to depends on their length of service:

1 Year — 7 days

2 years — 7 days

3 years — 8 days

4 years — 9 days

5 years — 10 days

6 years — 11 days

7 years — 12 days

8 years — 13 days

9 years and above — 14 days

Paid annual leave should be granted for an unbroken period. If the employee so requests, it may be granted in the following manner:

  • Leave entitlement not exceeding 10 days: up to 3 days can be granted separately; the balance should be granted consecutively
  • Leave entitlement exceeding 10 days: at least 7 days should be granted consecutively

An employee is entitled to pro-rata annual leave if their employment is terminated and they have completed between 3 and 12 months’ service in a leave year. This does not apply if the employee is dismissed by summary dismissal.

Parental leave in Hong Kong

Maternity leave in Hong Kong

In order to be eligible for 14 weeks of paid maternity leave in Hong Kong, expectant mothers must meet the following criteria:

  • They must have been employed under a continuous contract for at least 40 weeks leading up to their scheduled maternity leave.
  • They must give notice of the pregnancy and intention to take maternity leave to their employer after their pregnancy has been confirmed. This can be done by presenting a medical certificate confirming the pregnancy to the employer.
  • If required by the employer, they must produce a medical certificate specifying the expected date of confinement.

If the expectant mother has been employed under a continuous contract for less than 40 weeks immediately before the commencement of scheduled maternity leave, the employee is eligible for 14 weeks’ maternity leave without pay, as long as they have given notice of pregnancy and their intention to take maternity leave to the employer after the pregnancy has been confirmed.

Maternity leave pay in Hong Kong is 80% of the employee’s average daily wage over the past 12 months. If an employee takes consecutive days of paternity leave, then the pay is 80% of the average wage over the past 12 months divided by the number of days taken. If an employee has worked for less than 12 months, then the calculation is based on the shorter period.

The 4-week maternity leave pay for the 11th to 14th week of the maternity leave is subject to a cap of $80,000 HKD.

Paternity leave in Hong Kong

Paternity Leave in Hong Kong applies to the father of a child. Employees may take up to 5 days of Paternity leave as long as they provide you notice of a minimum of 3 months before the due date and at least 5 days’ notice of the dates of the actual Paternity leave.

The Paternity leave pay in Hong Kong is 80% of the employee’s average daily wage over the past 12 months. If an employee takes consecutive days of paternity leave, then the pay is 80% of the average wage over the past 12 months divided by the number of days taken. If an employee has worked for less than 12 months, then the calculation is based on the shorter period.

Sick leave in Hong Kong

Sick leave is payable in Hong Kong at a rate of 80% of the employee’s daily wage if the employee has accrued sufficient sick days and takes a minimum of four consecutive days. They must also provide a medical certificate.

Accrual of sick days (up to a maximum of 120 days accrued):

  • less than 1 year of employment: 2 days/month
  • less than 1 year of employment: 4 days/month

Bereavement and compassionate leave in Hong Kong

There is no legal requirement for bereavement or compassionate leave in Hong Kong, but many employers offer some paid leave in the event of a death in the immediate family. Some employers may also offer paid leave in other compassionate circumstances, such as a serious illness in the family.
