What is the minimum notice period when resigning in Hong Kong?

The minimum notice period in Hong Kong is 7 days if stipulated in the employment contract. If no notice period is specified in the contract, then a minimum of 1 month’s notice applies.

Is it possible to reduce the notice period in Hong Kong under exceptional circumstances?

Yes, it is possible to reduce the notice period in exceptional circumstances, but employers will need to ensure that they pay the following: 

  • A payment in lieu of notice.
  • A severance or long service payment (if conditions are satisfied).
  • Accrued annual leave.
  • A proportional end-of-year payment.

 If the employee is dismissed summarily, no notice or payment in lieu of notice is required.
