Annual leave in USA (holiday / vacation)

Employees in the US are not legally entitled to vacation leave or paid time off (PTO) as standard. The FLSA does not require employers to pay their employees for time not worked, such as vacations, sick leave or federal or other holidays. 

Instead, PTO is a matter of agreement between employer and employee. Most employers do offer some PTO as part of their employee benefits package, but the amount varies massively from employer to employer. 

In comparison to their Canadian and European counterparts, American employees get significantly less paid time off. Factors such as the length of service and type of work affect the amount of PTO. In the USA, 10 to 14 days is considered a generous PTO allowance for employees who have worked with the same company for at least one year.  

Parental leave in USA

The Family and Medical Leave Act (FMLA) entitles eligible employees to take unpaid, job-protected leave for specified family and medical reasons. Under the FMLA, new parents can take 12 work weeks of unpaid leave over a 12-month period to care for the newborn child within its first year of birth. 

At the time of writing, 11 states and the District of Columbia provide paid parental leave, and many employers choose to offer it as part of their employee benefits packages. 

Maternity leave in USA

Paid maternity leave is a matter of agreement that’s left to employers to decide upon. Unpaid maternity leave is most commonly taken under the FMLA, however, coverage only extends to employers with 50 or more employees within a 75-mile radius. 

A number of states offer state-wide partially-paid maternity leave. For example, The California Paid Family Leave insurance program grants 8 weeks of paid leave for parents to bond with a newborn child. The program is administered through the state’s disability program and is funded through employee-paid payroll taxes.

Paternity leave in USA

Under the FMLA, fathers are entitled to 12 weeks of unpaid, job-protected paternity leave. Paid paternity leave is generally considered part of employee benefits packages rather than an expected right. 

Sick leave in USA

There are no federal laws that entitle US employees to paid sick leave. The Family and Medical Leave Act (FMLA) does grant up to 12 weeks of unpaid sick leave over a 12-month period. 

Most employers choose to offer paid sick leave as part of an employee benefits package or paid time off policy. Keep in mind that some states and a number of localities have legislation requiring employers to provide paid sick leave. It’s crucial that you understand the local laws when hiring employees in the USA.

Bereavement and compassionate leave in USA

Bereavement or funeral leave is not covered in the Fair Labor Standards Act (FLSA). At the federal level, there is no legal requirement for employers to pay employees for any time not worked. Bereavement, funeral or compassionate leave is generally unpaid and taken as part of the sick leave entitlement. 

The amount of time allowed for bereavement and compassionate leave is usually dependent on individual employment agreements. Few US states have specific laws relating to bereavement leave in place. Oregon and California are two examples with California requiring employers with at least five or more employees to grant up to five days of unpaid bereavement leave.
