The minimum notice period when resigning in the Philippines is 30 days.
If the employer fails to provide the appropriate notice period for termination, the employee may be entitled to receive severance pay equivalent to the employee’s salary for the notice period.
If an employee resigns without giving the required notice period, the employer may withhold the equivalent salary for the notice period from the employee’s final pay. This is to compensate the employer for any inconvenience caused by the abrupt resignation.
Yes, it is possible to reduce the notice period in the Philippines under exceptional circumstances, but it generally requires mutual agreement between the employer and the employee. In cases of gross misconduct or serious violations of company policies, the employer may choose to terminate the employee immediately, and the notice period may be waived.
Lastly, the employer can always agree to release the employee early from the notice period but provide compensation or payment in lieu of the remaining 30-day period.
