In addition to public holidays, employees get a minimum of 15 days in annual leave per year. However, it is standard to give 20 days.
In South Africa there are 12 public holidays per year. In 2023 they are as follows:
South Africa provides paid leave to both mothers and fathers through maternity and paternity leave.
Workers in South Africa are entitled to at least 4 consecutive months of maternity leave. The maternity leave can begin at any time from at least 4 weeks before the birth of the baby.
Fathers in South Africa are entitled to 10 working days of paid paternity leave after a child’s birth.
During the first 6 months of employment, workers are only entitled to 1 day of paid sick leave for every 26 days worked.
South African labor law does not have any specific legislation solely dealing with compassionate leave in the event of bereavement. However, the Basic Conditions of Employment Act, 1997 (BCEA) provides for what is termed family responsibility leave.
Family responsibility leave is granted to employees who have worked for their employer for longer than 4 months and who work at least 4 days a week. During each 12-month cycle, an employee is entitled to 3 days of paid family responsibility leave. This leave can be taken when an employee’s child is born or falls ill, when an employee’s spouse or life partner falls ill or when a close family member dies.
