Annual leave in India (holiday / vacation)

Annual leave requirements depending on the location and type of work an employee works in. This is regulated by each states respective Shops and Establishment Acts. Generally, the average employee is entitled to three types of leave including:

  • Paid annual leave which equates to a minimum of 15 days per year
  • Sick leave for around 7 days per year
  • Casual leave that is granted for unforeseen situation for around 8 days per year

This means an employee is obligated to around 30 days of paid annual leave days per year. This does not include statutory national holidays which is an extra 3 days per year. Any other public holidays are state based and is determined by the company based on local customs. Annual leave is based on an accrual system whereas employees can request to take annual leave after 6 months of employment. There is a carry-over system of 24 months, up to 30 days of annual leave that an employee can accrue before it is reset.

Parental leave in India

In India, employees are entitled to maternity leave or adoption leave as long as they meet certain eligibility requirements.

Maternity leave in India

Any employee that works for an employer with more than 10 employees, and has worked for an organisation for longer than 80 days is entitled to maternity leave benefits. The standard amount of maternity leave granted is 26 weeks leave if it’s an employee’s first or second pregnancy. If it’s an employee’s third child or more, they are only entitled to 12 weeks maternity leave for each subsequent pregnancy. Maternity leave must start at least 8 weeks before the expected birth and it is prohibited to work for the first 6 weeks after childbirth. Maternity leave is paid by an employer and equates to 100% of the employees salary.

Paternity leave in India

There is no mandatory requirement for an employer to give paid or unpaid paternity leave. Any paternity benefits are organised at the employers discretion.

Sick leave in India

Sick leave is not a mandatory benefit in India. However, it is common practice to allow employees to have 7 days of paid sick days per year as part of their employment contracts. Some companies may even allow for up to 15 days of paid sick leave per year.
