As the most populated country in the world, this means that India is well positioned to have access to the largest pool of local talent to be able to fill almost any employment opportunities that exist in the country. Due to this factor, the Indian government has implemented stringent rules for foreigners to be able to work and live in India.
Nonetheless, there are two types of work visa types that can be granted to foreigners who are seeking to work or do business in India. Foreigners can apply for either an Employment Visa (EV) or a Business Visa depending on the type of work that will be undertaken in India.
An Indian Employment Visa and is only available to foreigners who are considered to be highly skilled, qualified or educated and will be working in a role that cannot be filled by an Indian national. This visa is commonly granted to foreigners who are moving to India with large multinationals with a branch in India, will undertake employment on a steel or major construction project or . This visa is usually granted for 1 year but can be extended from within India given that the nature of employment has not changed.
An Indian Business Visa is issued to foreigners who are seeking to establish a business in India, is looking to invest in India or need to take frequent business-related trips to India. The main difference between a B-visa and an E-visa is that a foreigner will not be able to reside in India on a business visa for over 180 days in a year or uptake unrelated employment to which the B-visa was granted. This visa can be granted on a single entry or multiple entry capacity and can be issued for between 1 to 10 years of validity.
The documents required to acquire a work permit in India differs depending on the type of visa you are applying for or require.
Documents for the E-Visa
There are several mandatory documents that are required to apply for an Employment Visa in India. An eligible foreigner must provide:
A valid Passport
Two passport sized photos
A notarized copy of the first pages of the foreign national’s passport
A valid employment contract or appointment letter from the Indian employer that specifies the terms of employment, including pay structure, contract period, nature of work
A copy of the employer’s company registration certificate
Two completed visa application form
A copy of the foreigner’s resume
Copies of documents that proved educational and professional competencies
Document for A B-Visa
To apply for a business visa, applicants must provide:
A valid passport with at least 6 months validity remaining
2 passport sized photos of the applicant’s face
Name, Address, Website of the Indian organisation, or event being visited on business
Copy of passport
Invitation letter or personal information about the applicants’ credentials
All employment and business visas must be applied for by the foreign national in their country of residence or domicile at the nearest Indian embassy or consulate that handles visa applications. However, foreign nationals from the United States, United Kingdom, a member, European Union, Canada, Australia, or New Zealand may be able to apply for a business visa online.
It is not possible to apply for an employment visa inside India. All visas are allocated prior to entry into India from the relevant Indian Embassy in the foreign nationals country of residence.
There are a few special notes to take notice of in regard to Indian employment and business visas. The Indian Ministry of Home Affairs stipulate different provisions depending on the nationality of the foreign applicant. Some of these stipulations include:

On average, Indian visas take around 5 business days from confirmed lodgement to be approved. This approval rate is based on certain nationalities and all required documents being submitted.
A foreigner on an Employment Visa can stay in India for the duration they remain employed with the company they applied for the visa with. However, the visa is only granted for 1 year initially and the foreign national will need to extend their employment visa within India once this time lapses. For a business visa, applicants may be approved a visa that has a validity of 5 or 10 years with either single or multiple entry conditions. On a business visa, applicants cannot remain in India for longer than 180 days after each entry without registration.
