Thailand offers mandatory parental leave benefits to workers in the public sectors, and only mandatory maternity benefits for employees in the private sector.
Maternity leave entitlements are included as part of the employer and employee social security contributions. However, to be eligible to receive maternity benefits, social security contributions will need to have been made for at least five months in the last 15 months. Once eligible an employee is entitled to 98 days of maternity leave each pregnancy (up to two pregnancies in their lifetime). Maternity leave is paid to the employee by the employer for 45 days and the remainder from the Social Welfare Fund.
Employees who work in private employment do not receive any sort of mandatory paternity leave if their partner gives birth. For workers in the Thai Public Sector, new fathers are entitled to 15 days paid paternity leave.
Private employees in Thailand are entitled to 30 days of paid sick leave per year. Employees must provide a valid medical certificate if they take more than three consecutive days off work from illness.
There is no mandated bereavement or compassionate leave policies in Thailand. It is common practice though for employers in Thailand to include their own policy around this type of leave for employees.
