In Thailand, the maximum allowable probationary period cannot exceed 119 days. There is no mandatory minimum, and the majority of employers tend to stick with the whole 119 days. This is because the longer the trial period, the more time you get to decide if the new employee is the right fit.
Probationary periods are not mandatory in Thailand or standard practice. However, many companies that do hire an employee with a probationary period will typically last up to 119 days. This is because Thai Law mandates severance payments to be paid if employment extends past this.
If an employer extends a probationary period past 119 days, they are obligated to pay that employee a severance payment if terminated past this time. They will also require giving an employee at least 30 days’ notice for termination of employment, regardless of if the employee is still in a probationary period.
It is possible to terminate an employee without reason up to 119 days of employment.
Employers do not need to give employees on a probationary period that is still within 119 days’ notice of their termination. Employers will also not need to make severance payments to the employee.
Your business can easily hire employees in Thailand without opening a local entity. We handle local employment law, complex tax regulations, and international payroll in 180+ countries worldwide. All you need to do is focus on your business.
Employers should give sufficient notice when terminating an employee on a probation period. An employee can be terminated without severance payment up until 119 days of employment.
There is no mandated amount of time that an employee needs to give to their employer to resign during a probation period. It is good practice to give an employer some notice when resigning from any form of employment, even if it is not working out during a probationary period.
